Terms of use

Nodz is in open beta. This document describes how the service works today; it may still be refined, and we will announce material changes here before they apply.
1. About these terms
These terms apply to the Nodz website and apps (the "service"), provided by DevBiz, WALSTRAAT, 8020 OOSTKAMP, BELGIUM ("we"). By creating an account you agree to them. Our privacy policy explains how we handle personal data.
2. Who may use Nodz
You must be at least 16 years old. Accounts are personal; automated or bulk registration is not allowed.
3. Your account and your keys
- Your username is permanent and cannot be changed or transferred.
- You are responsible for keeping your password and recovery code secret and safe.
- Nodz is designed so that we cannot read your messages or reset your encryption. If you lose both your password and your recovery code, your account and encrypted history cannot be recovered. There is no back door.
4. Acceptable use
You may not use Nodz to:
- break the law, or share content that is illegal, including child sexual abuse material;
- threaten, harass or stalk others, or impersonate someone;
- send spam or unsolicited bulk messages, or distribute malware;
- attack, overload, probe or reverse-engineer the service in ways that harm it or other users (good-faith security research under our disclosure policy is welcome).
5. Enforcement and reports
We cannot read message content, so we rely on reports. Users can report abuse to abuse@nodz.im and may include messages they have received. If we have good reason to believe these terms are broken, we may limit, suspend or close an account. Where the law requires it, we will explain our decision and how to object.
6. Your content
What you send remains yours. Because it is end-to-end encrypted, we only store and transmit it in a form we cannot read, and only to deliver it.
7. Availability
Nodz is under active development and offered free of charge, as it is. We work to keep it secure and available, but we cannot guarantee uninterrupted operation, and features may change. We will announce material changes in advance where reasonably possible.
8. Donations
Donations are voluntary gifts to support the service. They do not buy any service, feature or priority. Payments are processed by Mollie. Donations are not refundable, except where the law requires otherwise or in case of an obvious error; contact hello@nodz.im.
9. Liability
To the extent the law allows, we are not liable for indirect damage, or for loss of data that results from lost passwords or recovery codes. Nothing in these terms limits liability for intent or gross negligence, or rights you have as a consumer under mandatory law.
10. Ending your use
You can delete your account at any time in the app. We may end the service or an account in line with section 5, or if we discontinue Nodz, in which case we will give reasonable notice.
11. Changes to these terms
We will announce changes at least 30 days before they take effect, unless they are required by law sooner. If you do not agree, you can delete your account before then.
12. Law and disputes
These terms are governed by Belgian law. Disputes go to the competent court in Brugge, Belgium. If you are a consumer living elsewhere in the EU, you keep the protection of the mandatory laws of your country and may also go to your local court.
